The Government of India has issued an ordinance to suspend the initiation of insolvency proceedings for 6 months to shield companies impacted by the coronavirus pandemic. The Insolvency and Bankruptcy Board of India (IBBI) is also working to create a special insolvency resolution framework for Micro, Small, and Medium Enterprises. This is expected to have a pre-packaged resolution framework wherein the company and its creditors will agree upon a resolution plan in advance.


These steps are expected to strengthen the Insolvency and Bankruptcy Code by creating an acceptance for genuine business failures and consequently nurturing entrepreneurship.
